Terms of Service

Welcome to Sumigyan! These Terms of Service (“Terms”) govern your access to and use of the services provided by Sumigyan (“we”, “us”, or “our”). By using our services, you agree to be bound by these Terms. Please read them carefully before using our services.
1. Services Provided
We offer web development services that include but are not limited to:
- Custom website and web app development
- E-commerce solutions
- Website maintenance and ongoing support
- UI/UX design
- SEO optimization and performance tuning
2. Client Responsibilities
By using our services, you agree to:
- Provide timely and accurate information and resources needed for the project.
- Review and approve project deliverables and milestones promptly.
- Provide content, media, and other necessary materials for the website as required.
- Respond to communications and feedback requests within agreed timelines.
Failure to comply may result in project delays, and Sumigyan is not responsible for such delays.
3. Payment Terms
All projects are divided into milestones, with a 20% deposit due before any development begins. The remaining payments will be scheduled based on milestone completion.
Payment structure:
- Initial Deposit (20%): Due upon project commencement.
- Subsequent Payments: Due upon completion of each milestone. The percentage amount will depend on the complexity of the milestone, as outlined in the project agreement.
- Final Payment: The remaining balance is due upon completion of the final milestone and approval by the client.
In the event of delays caused by the client, additional charges may be applied for the extended project duration.
4. Late Payments & Project Pauses
A 5% late fee will apply if payments are not received within 5 days. If the balance remains unpaid after 7 days, we reserve the right to suspend or terminate services. Any project paused for more than 15 days due to late payments will require an additional reactivation fee.
5. Milestones and Timelines
Project timelines will be outlined before the start of the project, with deliverables attached to each milestone. We aim to complete milestones on time, but delays may occur due to unforeseen circumstances, including lack of timely feedback from the client. Any such delays will be communicated as soon as possible, and timelines may be adjusted accordingly.
If the client fails to provide feedback or approval within 3 days after each milestone submission, the milestone will be considered approved, and work on the next milestone will begin.
6. Revisions and Additional Changes
Each milestone includes a certain number of revision rounds. Any changes beyond the scope of the agreed revisions will incur additional charges, which will be communicated in advance.
7. Ownership and Intellectual Property
Upon full payment, ownership of the final website and all associated files is transferred to the client. However, Sumigyan retains the right to use the project in its portfolio unless otherwise agreed upon.
The client is responsible for ensuring that all materials provided (content, images, etc.) comply with copyright laws. Sumigyan will not be held liable for copyright infringements due to client-provided materials.
8. Termination & Refunds
Either party may terminate the project at any time with written notice. If the client terminates the project after the first milestone is completed, they will be responsible for all work completed up to that point. No refunds will be provided for completed milestones.
Any outstanding balance for work already completed will still be due. Refunds for incomplete milestones will be considered on a case-by-case basis, depending on the amount of work done.
9. Confidentiality
We will treat all client-provided information as confidential and will not share it with third parties without the client"s consent, except where required by law.
10. Warranty and Support
We offer 30 days of free technical support after project delivery. Post-delivery support for new features, updates, or any maintenance beyond this period will be charged separately.
We ensure that the website will be compatible with modern browsers but cannot guarantee functionality across all devices and software versions.
11. Limitation of Liability
Sumigyan will not be held liable for any direct or indirect damages resulting from the use or inability to use our services, including lost profits or data.
12. Governing Law
These Terms are governed by the laws of Bhopal, and any disputes will be handled in the courts of Bhopal.
13. Amendments to Terms
We reserve the right to update these Terms at any time. Changes will be communicated to the client, and the updated Terms will be posted on our website. Continued use of our services after the update signifies acceptance of the new Terms.
